Comair filed a second suit against the Federal Aviation Administration in U.S. District Court, claiming it shares responsibility for the August crash at Blue Grass Airport in Lexington, and should contribute to settlements for victims' families, the Lexington Herald-Leader reported Friday.
The regional airline filed its first suit in October, naming the FAA and Lexington Urban County Airport Board as defendants, and also filed an administrative claim against the FAA.
That claim was denied in January. Kate Marx, a spokeswoman for Comair, told the Herald-Leader the claim was a procedural step that cleared the way for Comair to pursue its claims in court.
Comair claims the agency and board were negligent because only one controller was on duty at the time of the crash, and the pilots didn't have accurate airport diagrams, among other issues. It is asking for $18 million in damages.
Lawsuits filed against Comair, the FAA and the airport board by victims' families are still pending.
Erlanger-based Comair, a subsidiary of Delta Air Lines (Pink Sheets: DALRQ), operates from the Cincinnati/Northern Kentucky International Airport.
